Swish of the Curtain Theatre School is fully committed to the safeguarding and well-being of its pupils and staff. We are dedicated to providing a secure environment for all of our members.

Class sizes are kept in line with Ofsted regulations in order to ensure EVERY child receives the focus and individual nurturing they require.

All teachers are regularly DBS checked and First Aid trained for complete peace of mind.

Terms & Conditions

Swish Theatre School (Swish/Us/We/Our) – Terms and Conditions

This agreement sets out the terms governing the relationship between you and us.

We reserve the right to make changes to these terms and will communicate any change to you at the address or email specified by you. Proof of sending such notice shall be sufficient evidence of receipt. You may cancel this agreement in accordance with the TERMINATION terms detailed below.

TASTER COURSE: All new students can attend a Taster Course for 2 consecutive weeks before joining. The cost of this varies according to the activity and/or age of the student.

CLASSES: Class timetables and teachers will be subject to change from time to time without notice. A teacher may, at any time, ask your child to leave a class if they are jeopardising the safety or enjoyment of others or their educational experience. You shall ensure that your child complies with the instructions of the teacher. All children must be toilet trained to attend our classes.

CAMPS & WORKSHOPS: For any bookings for extra curricular or out of term events, payment in full must be made prior to the start of the event. Any monies paid are non-refundable.

PAYMENT: Payment on the 1st of each month via automated debit/credit card for all Swish fees is mandatory. The class prices are set out on our website and the amount payable for your child is set out on the invoice which shall be paid monthly on the first day of each month. Class fees are payable in 12 equal monthly instalments from September to August. Price increases will occur no more than once annually – 1 month’s notice of any price increase will be given by Us in advance. In the event that you do not make the tuition fee payments when due, Interest is payable on any sums not paid when due at the rate of 3% p.a. above the base lending rate of RBS Bank plc calculated daily.

PROMOTION: We reserve the right to use any individual or group photographs or movie shots of your nominated child for press or promotional purposes. This includes social media platforms. If you do not want your child to appear in such publicity, please indicate at the time of registration. All intellectual property rights, design rights and image rights in these photographs or movie shots will belong to Us.

BEHAVIOUR: Bullying, harassment, abuse or other inappropriate behaviour by you or your child, at any time, is strictly forbidden and will result in immediate expulsion by Us from the school and we reserve the right to take such other legal action as may be appropriate.

TERM AND TERMINATION: Termination of membership must be given by e-mail to: info@swish.school. One calendar month’s notice is required for all disciplines. The time of sending shall be the time of commencement of the notice period once we have acknowledged receipt, which will come into effect at the end of the current calendar month. No refunds will be given for part months. Notice given for the end of the academic year (July) will require payment in full of the August instalment. If there is a problem with the tuition please contact us as soon as possible and give us a reasonable opportunity to rectify the problem. You may terminate this agreement at any time if the tuition provided to the child falls below, on more than one occasion, the standards of reasonable skill and care normally expected to be provided for such tuition.

EVENTS OUTSIDE OUR CONTROL: We will not be liable or responsible for any failure to perform, or delay in performance of, any of Our obligations under these Terms that is caused by any event caused by you or outside our reasonable control. We will use our reasonable endeavours to contact you in these circumstances.

LIMIT ON OUR LIABILITY: Subject to OUR LIABILITY detailed below, if We fail to comply with this agreement We will be liable to you for the loss or damage you suffer as a result of our breach of these terms or our negligence, but We will only be liable up to a maximum of the amount you have paid for your membership (including monthly card payments) in each year of membership.

OUR LIABILITY: We do not exclude or limit in any way Our liability for:

  • Death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors;
  • Fraud or fraudulent misrepresentation;
  • Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession); breach of the terms implied by sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples); and
  • Defective products under the Consumer Protection Act 1987.

YOUR INFORMATION: We will use the personal information you provide to us to provide the tuition; process your payments for such tuition and membership; and inform you about similar products or services that we provide, but you may stop receiving these at any time by contacting us. We will not give your personal data to any third party.

OTHER TERMS:

  • This contract is between you and Us. No other person shall have any rights to enforce any of its terms;
  • We may transfer Our rights and obligations under these terms to another organisation, and We will always notify you in writing if this happens;
  • Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect;
  • If We fail to insist that you perform any of your obligations under these Terms, or if We do not enforce Our rights against you, or if We delay in doing so, that will not mean that We have waived Our rights against you and will not mean that you do not have to comply with those obligations. If We do waive a default by you, We will only do so in writing, and that will not mean that We will automatically waive any later default by you.
  • This agreement is governed by the laws of England and Wales. You and We both agree to submit to the non-exclusive jurisdiction of the English courts.

Why we process personal data

We process personal data from customers who enquire about or subscribe to our companies in order to ensure customers get the best possible service from our team and to ensure that you are kept up to date with future products which might be of an legitimate interest.

We also process personal data about job applicants, current and former employees, service providers, and other groups of individuals in the course of employment and business operations, and this data is subject to our internal privacy policies.

What personal data do we collect?

Personal data you provide to us when you enquire, book or use our services. for example:

Your interactions with us will result in personal data being created and stored by us on our Account and CRM systems which are only accessed on a need to know basis by our own staff who have to login in and are only used for Invoicing and General and Future Communications.

No data is shared with any other party outside of Swish.

Personal data we create

We analyse the personal data we hold in order to improve the effectiveness of our direct marketing communications or to deliver our loyalty programmes. This can, in turn, generate personal data; for example, helping us to decide which marketing communications are likely to be of interest to you. This is done on a legitimate interest basis.

Sensitive personal data

We will only hold sensitive data which is pertinent to the safety of the students. This may include, but is not limited to their medical history.

We may hold sensitive data on employees, past employs and prospective employees, but this will only be used or processed for legal, public authorities or health reasons.

How we process personal data

We use personal data with your consent, or where it is necessary in order to:

  • Enter into a contract and deliver services for you;

  • Comply with a legal duty;

  • Protect your vital interests or the vital interests of those around you;

  • For our own lawful interests or those of other organisations, provided your rights don’t override these.

We will only use personal data about you for the purpose(s) it was collected for or closely related purposes, and will inform you or seek your consent if we need to use it for other purposes.

Enquiries

If you enquire about our services, or engage in competitions or other promotional activities that we provide, we may ask your consent to provide you with news and offers about our services that you may find of interest. Depending upon your preferences, our communications with you may include:

  • Email: We monitor our email communications, including where emails are undelivered and whether or not they appear to have been read. We may cease sending you email communications should we be unable to deliver email to you.

  • Calls: Calls made to us, and calls received from us, may be recorded for the purposes of audit, training and the monitoring of services provided by us.

  • Web: Visitors to our website may be tracked using analytics methods described in our Cookies Notice.

  • SMS: We may communicate urgent, time critical information by SMS message to existing clients.

You may withdraw or amend your consent to receive news and offers at any time.

Upon completion of your association with Swish, we may contact you to seek feedback on your experience to understand your satisfaction level so that we can improve the quality of services we offer.

Your rights concerning your personal data

You have rights over how we use personal data about you, and can exercise those rights by contacting Swish.

In some cases our ability to uphold these rights for you may depend upon our obligations to process personal data for security, safety, fraud prevention reasons, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.

Withdrawing consent to processing

Where we have obtained your consent for processing of personal data about you, you have the right to withdraw your consent at any time. Where we process personal data about you in ways for which your consent is not required, for example to record your history, you may ask us to cease processing, or restrict the nature of the processing, if you wish.

Accessing the personal data we hold about you

You may request a copy of the personal data we hold about you. This includes obtaining personal data about you in electronic form to provide to a third party should you wish to do so.

Ensuring the accuracy of personal data we hold about you

We will update or amend personal data we hold about you if you inform us of inaccuracies. We use publicly accessible data sources such as data brokers to maintain the accuracy of our enquirer and guest records.

Deleting personal data we hold about you

We retain personal data for the period required for processing, and where we are under an obligation to do so, for example billing data is retained in accordance with anti-money laundering and financial records keeping requirements.

We will delete personal data we hold about you if you ask us to do so, except where certain exemptions apply.

How to complain about our processing of personal data

Securing your personal data

We take the security of your personal data seriously, and use security policies, standards, technologies and ongoing training to safeguard the personal data we process from improper access, use, alteration, destruction and loss. 

Where we share your personal data with other companies as described above, we require those companies to process your personal data to an equivalent level of security.

Website and data collection

Web Chat

We may use online chat services to assist your use of our websites. These services may be provided by third party organisations acting as data processors on behalf of Swish. Where we receive personal data from you during the course of chats, we do not append it to records about you, and will process that personal data in accordance with our privacy notice.

Analytics

Our web servers may collect the domain names of visitors to our site. This information may be combined with information related to other users to measure the number of visits, average time spent on the site pages viewed, and so forth. This information may identify you. Swish may use this information for a variety of purposes, including to measure the use of our site, to improve our marketing and to improve the content we offer.

Emails

To receive up to date information and promotions, you will need to subscribe to our e-newsletters. This is accessible via our website and upon initial enquiry and/or enrolment.

Payments

If you make payment over the telephone, no credit card details are kept by our company.  They are used by our representative at the time and entered manually into a secure banking platform encrypted using SSL (“Secure Sockets Layer”). SSL is an industry-standard protocol for encryption over the internet. This helps to protect your personal data from being read by anyone else.

As with any standard email, emails containing your personal data sent to or from us will not be encrypted.
